    Terms of Service

    These Terms describe the baseline rules for using 3Allusion, including account eligibility, account access, uploads, prompts, generated output, billing, privacy, and enforcement.

    1. Contracting operator

    These Terms of Service ("Terms") govern access to and use of 3Allusion, a public AI creator platform for eligible users operated by 3Allusion e.U., Inhaber Lukas Dreiher ("3Allusion", "we", "us", or "our").

    These Terms are between you and 3Allusion e.U., Inhaber Lukas Dreiher, Großharras 231, 2034 Großharras, Österreich, operating 3Allusion / 3Allusion.pro.

    By creating an account, accessing the app, uploading content, requesting a generation, purchasing credits, or otherwise using 3Allusion, you agree to these Terms and the policies linked from them, including our Content Policy, Privacy Policy, Age Policy, Credit Terms, Billing Disclosure, and Refund Policy.

    If you do not agree, do not use 3Allusion.

    2. Eligibility

    You must be at least 18 years old to use 3Allusion. The Services are for adults only and are not intended for minors.

    By using 3Allusion, you represent and warrant that:

    • you are at least 18 years old;
    • you have the legal capacity to enter into these Terms;
    • the information you provide to us is accurate and complete;
    • you are not prohibited from using the Services under applicable law; and
    • you will comply with these Terms, our Content Policy, and applicable law.

    We may request age, identity, rights, consent, or other verification information where reasonably necessary to confirm eligibility, investigate complaints, prevent abuse, satisfy partner or platform requirements, or comply with law.

    Google login, email login, possession of a payment method, or a simple account acknowledgement is not formal age verification.

    3. Description of Services

    3Allusion provides AI-powered creator workflows, including character/reference workflows, image generation, image editing, photoshoot workflows, carousel creation, video generation, voice or audio features, upscaling, private asset storage, and related creator tools.

    Some features may be experimental, limited, rate-limited, unavailable in certain regions, subject to account status, subject to verification, restricted by payment-provider requirements, or changed during product rollout.

    We may modify, suspend, restrict, or discontinue any feature where reasonably necessary for product operation, legal compliance, safety, provider availability, abuse prevention, payment compliance, or business reasons.

    4. Accounts and Security

    You may need an account to use certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

    You must not:

    • share your account with another person;
    • sell, transfer, or assign your account;
    • use another person's account without permission;
    • bypass authentication, age gates, usage limits, payment checks, or safety controls; or
    • use automated access unless we expressly allow it.

    If you believe your account has been compromised or used without authorization, contact support@3allusion.pro.

    5. User Content and Output

    User Content means prompts, uploads, source images, reference images, videos, audio files, voice material, text, edits, instructions, metadata, support messages, abuse reports, and other material you submit to or through the Services.

    Output means content generated, modified, enhanced, transformed, returned, or otherwise produced by the Services based on User Content, settings, templates, models, or your instructions.

    You are solely responsible for your User Content, your prompts and instructions, your use of Output, and ensuring that your use of the Services complies with these Terms, the Content Policy, and applicable law.

    AI Output may be inaccurate, unexpected, offensive, biased, low-quality, similar to third-party material, or unsuitable for your intended use. You are responsible for reviewing Output before using, publishing, selling, or distributing it.

    You represent and warrant that you own, control, or have obtained all rights, licenses, permissions, releases, and consents necessary to upload, process, transform, generate from, store, use, publish, commercialize, and distribute your User Content and any resulting Output.

    If User Content or intended Output involves a real person's face, body, likeness, voice, name, identity, personal attributes, biometric identifiers, intimate image, or other personal data, you represent and warrant that you have all required rights and valid consent for the specific use.

    This requirement is especially strict for sensitive, identity-based, or higher-risk content.

    You must be able to provide reasonable evidence of rights and consent if we request it for safety, legal, abuse, payment, or platform-compliance reasons.

    You may not use the Services to sexualize, impersonate, deceive, harass, embarrass, exploit, blackmail, extort, or otherwise harm a real person.

    7. Restricted Features and Compliance Controls

    Certain features may be available only to eligible users and may be restricted by jurisdiction, trust signals, verification status, partner requirements, account status, or product rollout stage.

    Restricted workflows may require additional acknowledgement, age checks, identity checks, consent confirmation, usage restrictions, manual review, or other controls.

    Access to restricted features is a privilege, not a right. Hidden, disabled, unavailable, or restricted user interface elements do not create permission to use a feature or bypass a restriction.

    We may refuse or stop processing any request that creates legal, safety, consent, payment, provider, platform, or reputational risk.

    8. Prohibited Uses

    You must not use the Services to create, request, upload, process, edit, generate, publish, share, distribute, sell, promote, facilitate, or attempt to obtain:

    • content involving minors or persons who are, may be, or appear to be under 18;
    • sexualized depictions of any person who is, may be, or appears to be under 18, regardless of labels, prompts, disclaimers, art style, fictional framing, or AI-generated status;
    • child sexual abuse material or exploitative content of any kind;
    • non-consensual intimate imagery, whether real, synthetic, manipulated, deepfake, or AI-generated;
    • sexual violence, coercion, forced scenarios, assault, exploitation, trafficking, blackmail, extortion, or abuse;
    • deceptive or harmful sexualized depictions of a real person;
    • revenge porn, voyeuristic content, hidden-camera content, privacy-invasive sexual content, or content made for humiliation;
    • impersonation, catfishing, identity misuse, fraud, scams, harassment, stalking, threats, hate, or illegal activity;
    • content infringing copyright, trademark, privacy, publicity, data-protection, contractual, or other rights;
    • malware, credential theft, evasion, platform abuse, scraping, or attempts to compromise systems; or
    • attempts to evade moderation, age restrictions, verification, rate limits, credit checks, payment restrictions, provider restrictions, or safety controls.

    This list is not exhaustive. We may restrict additional content or behavior where reasonably necessary to protect users, depicted persons, third parties, payment partners, providers, or the Services.

    9. Depicted-Person Complaints and Removal Requests

    Any person who believes they are depicted in content processed, stored, or distributed through 3Allusion may submit a complaint or removal request through Report Abuse or by contacting support@3allusion.pro.

    We prioritize reports involving minors or under-18 concerns, consent violations, misuse of a real person's likeness, impersonation or catfishing, extortion, threats, rights infringement, or unlawful content.

    We may request information sufficient to identify the content, confirm the reporter's standing, verify the depicted person or rights holder, and review the complaint.

    While we investigate, we may disable access to relevant content, suspend processing, restrict an account, preserve evidence, or take other appropriate action.

    If consent cannot be established, if consent is invalid or withdrawn where legally effective, if the content violates policy, or if the content is unlawful, we may remove or block the content and take related account action.

    10. Moderation, Safety Checks, and Enforcement

    We may use automated systems, provider responses, manual review, metadata analysis, transaction checks, and user reports to enforce these Terms, the Content Policy, payment requirements, provider requirements, and applicable law.

    We may review prompts, uploads, source or reference media, outputs, usage patterns, account history, payment activity, abuse reports, and related metadata where reasonably necessary for:

    • delivering the Services;
    • preventing misuse;
    • enforcing account eligibility;
    • handling depicted-person requests;
    • investigating fraud, chargebacks, or abuse;
    • complying with law;
    • satisfying provider, storage, hosting, or payment requirements.

    If we reasonably believe that you, your User Content, your Output, or your account activity violates these Terms, the Content Policy, applicable law, provider rules, or payment requirements, we may:

    • refuse processing;
    • block, blur, watermark, delay, or remove content;
    • restrict tools or features;
    • require verification or documentation;
    • suspend or terminate an account;
    • cancel, delay, reverse, or refuse transactions;
    • withhold or forfeit credits to the extent permitted by law;
    • preserve evidence; or
    • report or escalate severe cases where appropriate.

    Where required by law, we will provide information about moderation decisions and available appeal or complaint options.

    11. Storage, Privacy, and Media Access

    User-linked media is intended to be stored privately and served through authenticated app routes or short-lived signed access where the current storage layer supports it.

    Approved marketing, demo, public showcase, or documentation assets may be public.

    You should not upload highly confidential, legally sensitive, or third-party material unless you understand the feature and have the necessary rights and consent.

    Our handling of personal data is described in our Privacy Policy. If there is a conflict between these Terms and the Privacy Policy regarding personal-data processing, the Privacy Policy controls for that issue.

    12. Third-Party Providers

    3Allusion uses third-party providers for hosting, storage, authentication, email, analytics, payment processing, AI generation, moderation, and related infrastructure.

    Selected features may send the prompts, uploads, source or reference media, audio, video, outputs, account metadata, or technical metadata needed to run the selected workflow to the relevant provider.

    Provider availability, model behavior, output quality, safety handling, pricing, processing time, geographic availability, and accepted input may change. We are not responsible for provider outages, model changes, rejected requests, delayed processing, or unexpected Output, except where mandatory law provides otherwise.

    13. Payments, Credits, and Checkout

    Certain features are paid and may require prepaid credits or one-time purchases. Prices, taxes, fees, payment methods, billing entity, and statement descriptor will be shown at checkout.

    Payments are processed by 3Allusion e.U. and/or its designated payment processors, acquirers, facilitators, billing partners, or authorized resellers, depending on the payment flow, region, and product configuration in effect at the time of purchase.

    Credits are digital prepaid units. They are not money, stored value, e-money, a bank balance, a gift card, or a financial product. Credits have no cash value, are non-transferable, cannot be sold, assigned, exchanged, withdrawn, or redeemed for cash, and can be used only inside 3Allusion.

    Purchased credits do not expire unless mandatory law or an individually disclosed legal or technical requirement requires otherwise.

    Credit costs may vary by tool, model, resolution, duration, provider cost, selected settings, account status, feature availability, and product configuration. We may change future credit costs, but changes do not retroactively alter credits already consumed.

    Credits are generally consumed when processing begins, when a paid action is initiated, or as otherwise disclosed in the product.

    14. EU Consumer Withdrawal Rights and Digital Content

    If you are a consumer in the EU, you may have a statutory right of withdrawal for certain online purchases.

    For digital content or digital services supplied immediately after purchase, checkout may ask you to expressly consent that performance begins before the end of the withdrawal period and to acknowledge that you may lose your right of withdrawal once performance begins, to the extent allowed by applicable law.

    Where credits or digital services have already been used, partially used, delivered, or consumed with your express consent and acknowledgement, refunds may be limited or unavailable to the extent permitted by law.

    Nothing in these Terms limits mandatory consumer rights that cannot be waived under applicable law.

    15. Failed Generations, Refunds, and Support Credits

    AI output quality can vary. A result that is stylistically different from what you expected, less attractive than expected, or not commercially useful to you is not automatically a technical failure.

    If a paid generation fails because of a technical error and no usable output is delivered, we may, depending on the situation and applicable law:

    • restore the consumed credits;
    • grant support credits;
    • rerun or remediate the request where technically reasonable; or
    • issue a refund where required by law or appropriate for the case.

    Accounts restricted or terminated for fraud, chargeback abuse, content-policy violations, minor-related content, consent violations, impersonation, rights violations, or other misuse may be ineligible for refunds or remaining credits to the extent permitted by law.

    16. Early Access Credits, Promotions, and Trials

    Early access credits, free credits, launch credits, promotional credits, reviewer credits, beta access, discounts, or trial features may be limited, revoked, changed, capped, watermarked, restricted to certain tools, or subject to additional conditions.

    Promotional access has no cash value and does not guarantee continued access to the Services or any specific feature.

    17. Intellectual Property in the Services

    The Services, website, software, interface, workflows, templates, prompts, model-routing logic, documentation, brand elements, trademarks, logos, design, and proprietary systems are owned by or licensed to 3Allusion and are protected by applicable law.

    Except as expressly stated in these Terms, no rights are granted to you in the Services or 3Allusion intellectual property.

    You must not copy, modify, reverse engineer, scrape, resell, sublicense, or exploit the Services except as permitted by law or expressly allowed by us.

    18. Rights in User Content and Output

    As between you and 3Allusion, you retain any rights you have in your User Content.

    You grant 3Allusion a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, transform, display, and otherwise use User Content and Output only as reasonably necessary to provide, operate, secure, support, moderate, troubleshoot, document, and improve the technical reliability of the Services, handle abuse reports, comply with law, and enforce these Terms.

    3Allusion does not use private uploads or private outputs for public marketing unless you separately agree.

    Subject to your compliance with these Terms, and to the extent permitted by applicable law and provider terms, 3Allusion does not claim ownership of Output generated for your account.

    However:

    • Output may not be unique;
    • similar or identical Output may be generated for other users;
    • we do not guarantee that Output is protectable by copyright or other intellectual-property rights;
    • Output does not grant you rights in any third-party person, likeness, trademark, copyrighted work, or protected material; and
    • your right to use Output depends on your rights in the User Content and compliance with law.

    19. Feedback

    If you provide feedback, ideas, suggestions, bug reports, or feature requests, you grant 3Allusion the right to use them without restriction or compensation, unless otherwise agreed in writing.

    20. Availability and Changes

    We aim to keep the Services available, but we do not guarantee uninterrupted, error-free, secure, or permanent access.

    The Services may be unavailable because of maintenance, provider outages, capacity limits, network issues, security incidents, legal restrictions, payment-provider restrictions, abuse prevention, or other reasons.

    We may update, change, suspend, or discontinue features, models, pricing, credit costs, limits, templates, provider routing, or product availability.

    21. Termination

    You may stop using 3Allusion at any time.

    We may suspend or terminate your account or restrict access where reasonably necessary for safety, law, abuse prevention, payment integrity, provider compliance, or violation of these Terms.

    After termination, provisions that by their nature should survive will survive, including rights and consent obligations, payment obligations, enforcement, intellectual property, disclaimers, limitation of liability, dispute provisions, and contact/reporting provisions.

    22. Disclaimers

    The Services and all Output are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and accuracy.

    We do not guarantee that:

    • a request will be accepted or completed;
    • Output will match your prompt or expectations;
    • Output will be accurate, lawful, non-infringing, or commercially usable;
    • safety systems will detect every prohibited request or output;
    • stored media will remain available indefinitely; or
    • any specific provider, model, workflow, or price will remain available.

    Mandatory consumer rights remain unaffected.

    23. Limitation of Liability

    Nothing in these Terms limits or excludes liability where limitation or exclusion is not permitted by applicable law, including liability for intent, gross negligence, death or personal injury caused by negligence, mandatory product liability, or mandatory consumer rights.

    To the maximum extent permitted by law, 3Allusion and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunity arising out of or related to the Services or these Terms.

    Our total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of:

    • the amount you paid us in the three months before the claim arose; or
    • EUR 100.

    24. Indemnity

    If you use the Services for business, professional, commercial, or creator monetization purposes, you agree to defend, indemnify, and hold harmless 3Allusion and its affiliates, officers, employees, contractors, licensors, providers, and payment partners from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

    • your use of the Services;
    • your User Content or Output;
    • your violation of these Terms, the Content Policy, or applicable law;
    • your infringement or alleged infringement of third-party rights;
    • your failure to obtain required rights, releases, or consent; or
    • your publication, sale, promotion, or distribution of Output.

    For consumers, this indemnity applies only to the extent permitted by mandatory consumer law.

    25. Changes to These Terms

    We may update these Terms from time to time.

    If changes are material, we will use reasonable means to notify users, such as updating the effective date, posting the new Terms, showing an in-app notice, or requiring renewed acceptance where appropriate.

    Changes do not retroactively affect completed purchases unless required by law or clearly disclosed.

    If you do not agree to updated Terms, stop using the Services. Continued use after the effective date of updated Terms means you accept the updated Terms, except where mandatory law requires a different process.

    26. Governing Law and Consumer Protection

    These Terms are governed by the laws of Austria, except where mandatory consumer law provides otherwise.

    If you are a consumer resident in the EU, you may also benefit from mandatory consumer-protection rules of your country of residence.

    Any dispute forum, venue, or jurisdiction rule applies only to the extent permitted by mandatory consumer law.

    27. Policy Hierarchy

    These Terms are supplemented by the Content Policy, Privacy Policy, Age Policy, Credit Terms, Billing Disclosure, Refund Policy, Report Abuse process, and feature-specific notices.

    If there is a conflict:

    • the Privacy Policy controls for personal-data processing;
    • checkout disclosures control for the specific transaction shown at checkout;
    • stricter safety, consent, or restricted-feature rules control for higher-risk content; and
    • mandatory law controls over all policy terms.

    3Allusion is a public AI creator platform for eligible users. At launch, anyone who meets the applicable eligibility requirements and accepts the required Terms, Content Policy, and product notices may use the available services, subject to rights and consent requirements and applicable law.
